Think Bagsy is a community lending and borrowing platform, which allows its users to share everyday household items among themselves. We use “Think Bagsy” here to refer to the Think Bagsy website(s) and any iOS and Android apps that are created in the future (also referred to as our “Services”). We also use “Think Bagsy”, “we”, “us” and “our” to refer to the companies operating our Services.
BY ENTERING INTO THIS AGREEMENT, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND AND AGREE WITH ALL OF THE TERMS OF THIS AGREEMENT.
Each person is limited to one account, and you may not share your account password with anyone else or allow someone else to use your personal account.
When you register for Think Bagsy you must use your real name, not a pseudonym. Submitting inaccurate registration information, registering if you know you don’t meet our eligibility requirements, or otherwise providing false registration information is a violation of this Agreement and could constitute a crime.
You may not use our Services if: (1) you are a registered sex offender or share a household with one; (2) we previously disabled your account for violations of our terms or policies; or (3) you are prohibited from receiving our Services or platform under applicable law.
Think Bagsy reserves the right to refuse registration to any person and to suspend, delete or deactivate your account at any time and without warning, without liability to you.
2. Privacy and preferences.
The Services cannot be provided and the Agreement cannot be performed without Think Bagsy processing data about its members and visitors. The provision of personalised content including ads is essential to the provision of our Services and a core part of our agreement with you.
3. Content and feedback.
You retain all ownership rights to the items, text, photos, responses and other content you submit to Think Bagsy (collectively, your “Content”). You give us permission, in the form of a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license, to use, copy, and publish your Content. This means, for example, if you post an item with a description and image on Think Bagsy, you give us permission to store, copy, and share it with others. You agree not to post any Content that you don’t have the right to publish, or that is defamatory, infringing, illegal or otherwise tortious. We do not moderate Content posted by members; however, we can remove Content posted by you at any time and without warning if you violate this Agreement.
You give us permission to use your name and profile picture, and information about actions you have taken on Think Bagsy next to or in connection with ads, offers and other sponsored content, with no additional compensation to you.
We welcome you to submit feedback about Think Bagsy, so long as you understand we may have already had the same idea, and you agree that we are free to use any feedback you voluntarily provide with no restriction or obligation (payment or otherwise) to you.
4. Interactions with other members.
4.1. Be kind
At Think Bagsy, we believe that kindness towards others is paramount. Any ill treatment of other members or their property will be taken very seriously and may result in your account being terminated without warning.
4.2. Treat other people’s possessions with respect and care.
When you borrow an item on Think Bagsy you agree to take good care of that item, which includes to not damage or destroy the item. You agree to return the item in the condition it was given to you, with the exception of reasonable wear (for example, if you borrow a garden spade, it is reasonable that it may be returned with mud on it). You agree to return the item in the time frame agreed with the owner. We reserve the right to charge you for a replacement item and if necessary report any acts of theft to the police if these terms are violated.
4.3. Lending your items to other members.
By posting an item and listing it as available to borrow, and by lending out an item, you confirm that you own the item in its entirety and have the authority to lend it out. You also accept full responsibility for the item and the decisions and actions taken regarding the act of lending it. However, if you feel the member borrowing the item has violated the terms of this Agreement, please contact us immediately.
5. Disputes between members; waiver of claims against Think Bagsy.
While Think Bagsy is always here to try and help resolve conflicts or disagreements, we are not responsible for the actions of our members. According to applicable law, you release us (and our employees, associated parties and companies) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
6. Dispute resolution.
If you have a dispute with Think Bagsy, you agree to contact us and try to resolve the dispute informally and amicably before pursuing other avenues.
We can amend this Agreement and any additional terms by notifying you of the changes (for example, by emailing you, or by posting an amendment notice on the website Homepage). If you keep using Think Bagsy, you accept and are bound by the new terms; if you disagree with the new terms, you should contact us and ask to delete your account.
If someone brings a claim against Think Bagsy (whether against the company or any of its employees or associated people) based on a harm you caused, you agree to reimburse us for any costs we incur in defending against that claim, including reasonable attorneys’ fees as well as damages.
9. Liability limits.
We are not liable for any lost profit (special, incidental, punitive, consequential) however it arises. We are not liable for any lost property. We are not liable for the actions of our members.
This agreement does not create any agency, partnership, joint venture, joint controllership, employment or franchise relationship. This Agreement is legally binding. If any part(s) of this Agreement are found under the law to be invalid or unenforceable, then only that specific part(s) shall be of no force and the remainder of the Agreement is still in full force and remains legally binding.
